Article VII of the Miami Gardens Code entitled, “Lobbyist” requires that all
lobbyists before engaging in any lobbying activities to register with the City
Clerk and pay a one-time annual fee of $250.00. This applies to all persons
who are retained (whether paid or not) to represent a business entity or
organization to influence “City” action. “City” action is broadly described to
include the ranking and selection of professional consultants, and virtually all-
legislative, quasi-judicial and administrative action. All not-for-profit
organizations, local chamber and merchant groups, homeowner associations, or trade associations and unions must also register however an annual fee is not required.

Staff Summary:
The attached ordinance calls for the General Election for the City of Miami Gardens to take place on
August 30, 2016, at which a Mayor will be elected for a four (4) year term; a Council member for
Residential Area Seat 1 will be elected for a four (4) year term; a Council member for residential Area
Seat 3, will be elected for a four (4) year term, and a Council member for at-large seat 5, will be elected
for a four (4) year term. The Ordinance also provides for the closing of the election books (registered
voters) thirty (29) days prior to the General Election. The qualifying dates for candidates will begin at
9:00 AM, Thursday, May 26, 2016, and end Thursday June 3, 2016, at 4:00 p.m. sharp!
A Run-Off Election, if necessary will take place Tuesday, November 8, 2016.

That the City Council approves the ordinance calling the City of Miami Gardens General Election for
Tuesday, August 30, 2016.

WHEREAS, Section 5, Article V, of the City Of Miami Gardens’ Charter provides 14
that a general election shall be held in each even-numbered year, on the day of the first 15
state primary election, or if none is held in any such year, on the first Tuesday, following 16
the second Monday in September, and 17
WHEREAS, a state primary Election will take place on August 30, 2016, and 18
WHEREAS, state law requires election books to close thirty (30) days prior to the 19
election, 20
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL 21
OF THE CITY OF MIAMI GARDENS, FLORIDA: 22
SECTION 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas 23
Clauses are hereby ratified and confirmed as being true, and the same are hereby 24
made a specific part of this Ordinance. 25
SECTION 2. ELECTION: The 2016 General Election for the City of Miami 26
Gardens will be held on Tuesday, August 30, 2016. On that date, a Mayor, and Council 27
members for Residential Area Seats One (1), Three (3), and Five (5) will be elected to 28
serve for four (4) year terms. 29

SECTION 3. RUNOFF ELECTION: The 2016 Runoff Election, if necessary for 30
the City of Miami Gardens will be held on Tuesday, November 8, 2016. 31
SECTION 4. QUALIFYING: The qualifying period for the election shall open 32
Thursday, May 26, 2016, at 9:00 a.m., and close precisely at 4:00 p.m., on Thursday, 33
June 3, 2016. Candidates shall qualify at the Office of the City Clerk, 18605 N.W. 27th 34
Avenue, Suite 317, Miami Gardens, Florida 33056. 35
SECTION 5. POLLING PLACES: Voting shall be conducted at locations 36
listed on Exhibit “A”. All polls shall open precisely at 7:00 a.m., and close precisely at 37
7:00 p.m. 38
SECTION 6. OFFICIAL BALLOT: The official ballot for the 2016 Election is 39
in substantial form as the Ballot annexed to this ordinance as Exhibit “B”. 40
SECTION 7. VOTER REGISTRATION: The election books shall close 41
Monday, August 1, 2016. 42
SECTION 8. NOTIFICATION: The City Clerk shall publish notice of such 43
general election once a week for four consecutive weeks next preceding the general 44
election in a newspaper of general circulation in Miami Gardens. The notice shall 45
contain the date, time, and place of the general election and identify the Council Seats 46
to be voted for. 47
SECTION 9. CONFLICT: All ordinances or Code provisions in conflict herewith 48
are hereby repealed. 49
SECTION 10. SEVERABILITY: If any section, subsection, sentence, clause, 50
phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any 51
court of competent jurisdiction, such portion shall be deemed a separate, distinct and 52

independent provision and such holding shall not affect the validity of the remaining 53
portions of this Ordinance. 54
SECTION 11. EFFECTIVE DATE: This Ordinance shall become effective 55
immediately upon its final passage. 56

In 2009, under Ordinance Number 2009-06-178 Council approved the borrowing of $7.3 million for the
acquisition of economic development property located at NW 7 avenue extension and NW 7 Ave
(Warren Henry property). The bond Series 2009 which is held by Wells Fargo, NA is to be matured on
February 1, 2014 with a balloon payment of $6,311,999 in principal. The Council had approved three
ordinances to extend the balloon payment until February 1, 2016.
At the May 14, 2014 Council meeting, Council authorized the City Manager to negotiate and enter in to a
contract for the sale of the property. Numerous amendments to the contract for the sale have been
executed and the closing date has been extended beyond February 1, 2016. In December, Finance has
issued a Request for Proposal to seek responses for refinancing Series 2009. The City received only one
response from Bank United. The Commitment Letter issued by the Bank United has the following terms
and conditions:
a) Interest costs – variable rate based on 30 days LIBOR rate plus 2.25%
b) Revenue Pledge – Public Service Tax and State Revenue Sharing
c) Commitment fee – 0.50% of the issue amount
d) Bank Counsel fee - $7,500
e) Term: 3 year term, principal and interest payment semiannually in arrears with a balloon
payment at maturity date.
f) Pre-payment: the City of Miami Gardens can pre-pay the principal in whole or in part without
penalty on or after October 1, 2016, subject to providing the Bank a 60-day notice prior to
redemption of the bond.
g) Deposit – the City must establish a depository relationship with the Bank with a minimum target
balance of $3 million.
Fiscal Impact
The City has retained Jeff Decarlo from Weiss Serota Helfman Cole and Bierman law firm to prepare the
bond document and the ordinance. The cost is $14,000. All legal expenses include bank counsel fees
and the commitment fees will be part of the financing amount, so there is no immediate fiscal impact to
the General Fund. However, in mid-year should the property is still under contract, staff will submit an
Ordinance for Council approval to amend the budget to provide funding for the debt payment for fiscal
year 2016.

WHEREAS, on February 18, 2009, the City issued its $7,300,000 Taxable Land 17
Acquisition Revenue Bonds, Series 2009 (the “Prior Bonds”) for the purpose of financing 18
the costs of purchasing certain real property located in the enterprise zone as part of its 19
economic development activities and in order to foster economic growth in the enterprise 20 zone, and 21

WHEREAS, the City was in the process of obtaining financing to refinance the Prior 23
Bonds, but such financing did not became available prior to February 1, 2016, and 24
25
WHEREAS, the Prior Bonds matured on February 1, 2016, and the City paid the 26
outstanding amount of the Prior Bonds on such date from the City’s general fund, and 27
28
WHEREAS, the City desires to reimburse the general fund for such payment by 29
issuing bonds to refinance the Prior Bonds, and 30 31
WHEREAS, the City desires to authorize the borrowing of Six Million Four Hundred 32 Thousand Dollars ($6,400,000), and to authorize the issuance of bonds not exceeding Six 33
Million Four Hundred Thousand Dollars ($6,400,000) for the purpose of reimbursing the 34
general fund for the payoff of the Prior Bonds, thereby refinancing the Prior Bonds, and 35
paying costs of issuance of the bonds, and 36

WHEREAS, pursuant to Section 4.3 of the City’s Charter, an ordinance must be 38
adopted in order to authorize the borrowing of money, and 39 40

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 49
MIAMI GARDENS, FLORIDA, AS FOLLOWS: 50

SECTION 1. ADOPTION OF REPRESENTATIONS: The foregoing Whereas 52
paragraphs are hereby ratified and confirmed as being true, and the same are hereby 53
made a specific part of this Ordinance. 54

SECTION 2. BOND AUTHORIZATION: In accordance with the provisions of the 56
Charter of the City of Miami Gardens, Florida and Chapter 166, Florida Statutes, the City 57
Council of the City of Miami Gardens hereby authorizes the borrowing of Six Million Four 58
Hundred Thousand Dollars ($6,400,000). The City Council further authorizes Taxable 59
Land Acquisition Revenue Bonds (the “Bonds”) of the City to be issued in an aggregate 60 principal amount not to exceed Six Million Four Hundred Thousand Dollars ($6,400,000), in 61
one or more series, for the purpose of reimbursing the general fund for the payoff of the 62
Prior Bonds, thereby refinancing the Prior Bonds, and paying costs of issuance of the 63
Bonds. The Bonds shall be designated “City of Miami Gardens, Florida Taxable Land 64
Acquisition Revenue Bonds, Series 2016” or such other designation as may be approved 65 by supplemental resolution, shall be dated such date, shall be in such denominations, shall 66
be stated to mature in such year or years not later than four (4) years from their date of 67
issuance, shall bear interest at a taxable rate from their dated date at a rate or rates not 68
exceeding the maximum rate permitted by law at the time of issuance of the Bonds, shall 69
be subject to redemption at the option of the City at such times and prices, and shall have 70 such other details, all as shall hereafter be determined by the Council by supplemental 71
resolution.. The Bonds shall be secured by a pledge of the utilities service tax and revenue 72
received from State revenue sharing, as further specified by supplemental resolution of the 73
Council. The supplemental resolution may be adopted, and the Bonds may be issued, at 74
any time after the effective date of this Ordinance. 75 76
SECTION 3. AUTHORIZATION OF OFFICERS: The City Manager and the City 77 Finance Director are each hereby authorized to negotiate with banks and other financial 78

local law enforcement in reducing the incidences of crime and violence in the community.
Reverend Rogery Adams has continued to foster a viable and sustaining relationship with the Miami
Gardens Police Department, Miami Gardens Parks and Recreation, and an association of local churches,
ministers and residents of Bunche Park, as well as neighboring communities. The Miami Gardens-
Bunche Park Neighborhood Watch Program was developed in 2011 as a result of the activities and
awareness campaign of the S.A.V.I.O.R. initiative. The 7th annual S.A.V.I.O.R. rally is rescheduled for
Saturday, March 26, 2016, with a rally that commences at the corner of 152nd Street and NW 22nd
Avenue, culminating at Bunche Park.
Councilman Ighodaro recommends that the city recognize and support the Operation S.A.V.I.O.R., as an
amiable enterprise of civic engagement and an important component of the city’s priority of Public
Safety.
Councilman Ighodaro is requesting sponsorship for the event in the amount of $2,000.00 to be allocated
from Account No. 01-11-01-511-496-01, “Special Events Account”
Fiscal Impact
The funding will be derived from the Councilman Ighodaro special event account 01-11-01-511-496-01 in
FY 2016. After this allocation, no funding will be available in this account.

Background
The City leases roll off containers for the collection of waste at the City Hall, Parks and Recreation, Police
Department and Public Works facilities. A service referred to as refuse collection services picks up these
containers at different interludes depending on the needs of the Department. These containers are
used by our maintenance crews to dispose of litter and trash collected from the City Hall Facilities, Police
Department, Right of Ways and Parks. The current contract for this service has expired.

Current Situation
On December 21, 2015, Staff prepared specifications for Invitation To Bid (ITB) Number 15-16-022,
Refuse Collection of Leased Containers, which was solicited and posted on Demandstar. A broadcast
notice was sent to one hundred eighty-one (181) suppliers. Four (4) bids were received and publicly
read on January 12, 2016. The apparent low respondent is Waste Management of Florida, Inc., located
in Miami, Florida. The Procurement Department evaluated the bids for compliance with the
specifications (Exhibit 1).
The initial period of the proposed contract is for two (2) years, from date of award through February
2018, for a total maximum not to exceed amount of one hundred thirty thousand ($130,000) dollars for
a two-year period.
A copy of the proposal document and submittals are available at the Assistant to the Mayor and
Council’s Office for review.
Fiscal Impact
In Fiscal Year 2016, the City has provided a funding from the General Fund and Stormwater Fund in the
amount of $78,320 for refuse and trash collection service. The amount is within the proposed award
amount for a one year period.
Proposed Action:
It is recommended that the City Council approve the attached resolution authorizing the award to Waste
Management of Florida, Inc., and authorizing the City Manager to issue purchase orders for each
Department: City Hall Facilities, Police Department, Parks and Recreation Department and the Public
Works Department, not to exceed the annual budget allocation.

BACKGROUND
In April 2014, the City of Miami Gardens’ residents approved a General Obligation Bond in the amount of
$60,000,000 for the construction of and improvements to the City’s parks and related facilities. The City

Council subsequently approved a Bond Implementation Plan that lists and details the proposed
improvements at each park facility or municipal property.
On July 15, 2015, staff issued Request For Qualifications (RFQ) Number 14-15-034 for Norwood Park
and Pool Improvements, Step One, inviting Design-Build firms or teams to provide qualifications for
future design-build contract for a new recreational building, renovation of the existing pool house, new
playground and shade structure and related facility improvements, technical, schedule and cost
proposals to implement an overall improvement project at Norwood Park and Pool, located at 19401
NW 14th Avenue. A broadcast notice was sent to seven hundred seventy-one (771) vendors. Forty-one
(41) proposals were requested. The RFQ opened on August 20, 2015 and seven (7) proposals were
received and publicly read. The RFQ was prepared in accordance with Florida Statue 287.055
Consultants Competitive Negotiation Act (CCNA).
On September 1, 2015, the Selection Committee short-listed four (4) firms: D. Stephenson Construction
Inc.; Di Pompeo Construction Corporation; Recreational Design & Construction, Inc.; and West
Construction, Inc.
CURRENT SITUATION
The Procurement Department applied the City of Miami Gardens Business and Resident Economic
Growth Plan (CMG-BREP) preference to this project. D. Stephenson Construction, Inc.; Di Pompeo
Construction Corporation; Recreational Design & Construction, Inc.; and West Construction, Inc., were
compliant to the City of Miami Gardens Business Resident Economic Growth Plan (Exhibit 2).
On December 17, 2015, Request For Proposal (RFP) Number 15-16-023, Step Two, was issued to the four
(4) short-listed vendors. The RFP opened on February 2, 2016. Proposals from D. Stephenson
Construction, Inc.; Recreational Design & Construction, Inc.; and West Construction, Inc., were received
and publicly read.
City Staff reviewed the proposals and determined that D. Stephenson Construction, Inc., and
Recreational Design & Construction, Inc. were both non-responsive to the established Maximum Bid
Price requirement listed in the RFP. After evaluation of the proposal, City Staff determined that West
Construction, Inc. was both responsive and responsible to the requirements of the RFP. City Staff
recommended West Construction, Inc. for award (Exhibit 1).
A copy of the proposal document and submittals are available at the Assistant to the Mayor and
Council’s Office for review.
Proposed Action:
It is recommended that the City Council approve the recommendation for award for RFP Number 15-16-
023, Norwood Park and Pool Improvements, Step Two, to West Construction, Inc. and authorize the City
Manager to proceed with negotiations.

Complex’s amphitheater for the City’s first premiere multicultural music concert. Hundreds of adoring
fans enjoyed a night under the stars and enjoyed the multi-genre music of Erinsoho John, M.O.G., Filon
Jay, Miss African Roots USA Cultural Pageant Queen Rachel Louissant, Ayanbirin, Ivelisse Santos and the
award-winning artist Flavour.
The event highlighted a market that has gone underserved and who demonstrated through the support
of this event, is ready to have access to this type of world class entertainment which is as diverse as
South Florida and the City of Miami Gardens.
Councilman Erhabor Ighodaro would like to bring this event back to the City of Miami Gardens to fill the
gap and promote culture which drives economic activity. This International Music Festival will build
upon last year’s highlights to become an annual affair, promoting local, regional and international talent.
A grant application will be submitted to the Tourist Development Council Grants FY 2015-2016 for an
award of $25,000, projected ticket sales and sponsorships are the anticipated sources of funding.
Councilman Ighodaro is requesting sponsorship for the event in the amount of $1,000.00 to be allocated
from Account No. 01-12-01-512-492-00, “ City Manager’s Special Events Account” .
Fiscal Impact
After the above allocation, Councilman Ighodaro will have $1,500 available in the City Manager’s Special
Events Account.
Proposed Action:
Councilman Erhabor Ighodaro recommends the City Council authorizes the City Manager to take
appropriate actions to create the International Music Festival in the summer of 2016, by applying for
grant opportunities and executing contracts as necessary to produce the event.

Ordinance No. 2014-15-326 reestablished The City of Miami Gardens’ Progressive Young Adults
Committee (MGPYA).
Primary duties of the MGPYA is to keep the City Council informed of the issues that affect the City’s
young adults; give advice to the City Council with respect to issues that affect the City’s young adults;
recommend social, educational, cultural, and recreational activities for young adults and to assist with
the implementation of those activities at the direction of the City Council; work with the City Council on
providing service and leadership opportunities for the young adults in the city.

To accomplish the goals and objectives of the “Committee”, several initiatives have been identified:
• February 26, 2016 – Boo’d Up - A Relationship/Dance Conference. Issues for discussion will
include domestic violence, building positive friendships and relationships. This event is
scheduled to take place at Florida Memorial University’s Smith Hall. The event is free for FMU
students. There is a $5.00 charge for all others. There is no fiscal impact to the City of Miami
Gardens. It is the Committee’s intent to seek sponsorships for this event.
• March 2016 – Vote! This is a collaboration between Miami-Dade County Elections, Florida
Memorial University Student Government, St. Thomas Student Government Association, Miami
Job Corp Student Government Association and the City of Miami Gardens Junior Council Advisory
Committee. There is no fiscal impact to the City of Miami Gardens.
• May 1-7, 2016 – National Small Business Week. It is the intent of the
“Committee” to host a three (3) day business conference for small businesses. The workshop
will provide resource information for business and funding opportunities. The location for the
event is to be announced at a later date. This is a free event, with no fiscal impact to the City.
• August 2016- College Bound Workshop. This is the second annual College Readiness event,
which provides valuable information to studens at both Florida Memorial and St. Thomas
Universities about the City of Miami Gardens and it services during their college readiness week.
There is no fiscal impact to the City of Miami Gardens.
• October 2016 – Winter Formal. This event will highlight the year’s bright and rising stars. It is
the “Committee’s” intent to recognize the many intelligent, talented and outgoing individuals
residing in the City of Miami Gardens. This location for this event is to be announced at a later
date. There is a cost of $25.00 per person. In addition the “Committee” intends to seek
sponsorships.

The State of Florida uses these crimes for conformity in compiling statistics within the state and the nation. The
statistics for these crimes are reported to the Florida Department of Law Enforcement for inclusion in the Federal
