This applies to all persons who are retained (whether paid or not) to represent a business entity or organization to influence “City” action. “City” action is broadly described to include the ranking and selection of professional consultants, and virtually all- legislative, quasi-judicial and administrative action. All not-for-profit organizations, local chamber and merchant groups, homeowner associations, or trade associations and unions must also register however an annual fee is not required. Staff Summary: The attached ordinance calls for the General Election for the City of Miami Gardens to take place on August 30, 2016, at which a Mayor will be elected for a four (4) year term; a Council member for Residential Area Seat 1 will be elected for a four (4) year term; a Council member for residential Area Seat 3, will be elected for a four (4) year term, and a Council member for at-large seat 5, will be elected for a four (4) year term. The Ordinance also provides for the closing of the election books (registered voters) thirty (29) days prior to the General Election. The qualifying dates for candidates will begin at 9:00 AM, Thursday, May 26, 2016, and end Thursday June 3, 2016, at 4:00 p.m. sharp! A Run-Off Election, if necessary will take place Tuesday, November 8, 2016. Staff Summary: Item H-2) Ordinance First Reading Bond Refinancing 29 of 115 18605 NW 27th Avenue Miami Gardens, FL 33056 In 2009, under Ordinance Number 2009-06-178 Council approved the borrowing of $7.3 million for the acquisition of economic development property located at NW 7 avenue extension and NW 7 Ave (Warren Henry property). The bond Series 2009 which is held by Wells Fargo, NA is to be matured on February 1, 2014 with a balloon payment of $6,311,999 in principal. The Council had approved three ordinances to extend the balloon payment until February 1, 2016. At the May 14, 2014 Council meeting, Council authorized the City Manager to negotiate and enter in to a contract for the sale of the property. Numerous amendments to the contract for the sale have been executed and the closing date has been extended beyond February 1, 2016. In December, Finance has issued a Request for Proposal to seek responses for refinancing Series 2009. The City received only one response from Bank United. The Commitment Letter issued by the Bank United has the following terms and conditions: a) Interest costs – variable rate based on 30 days LIBOR rate plus 2.25% b) Revenue Pledge – Public Service Tax and State Revenue Sharing c) Commitment fee – 0.50% of the issue amount d) Bank Counsel fee - $7,500 e) Term: 3 year term, principal and interest payment semiannually in arrears with a balloon payment at maturity date. f) Pre-payment: the City of Miami Gardens can pre-pay the principal in whole or in part without penalty on or after October 1, 2016, subject to providing the Bank a 60-day notice prior to redemption of the bond. g) Deposit – the City must establish a depository relationship with the Bank with a minimum target balance of $3 million. Fiscal Impact The City has retained Jeff Decarlo from Weiss Serota Helfman Cole and Bierman law firm to prepare the bond document and the ordinance. The cost is $14,000. All legal expenses include bank counsel fees and the commitment fees will be part of the financing amount, so there is no immediate fiscal impact to the General Fund. However, in mid-year should the property is still under contract, staff will submit an Ordinance for Council approval to amend the budget to provide funding for the debt payment for fiscal year 2016. BOND AUTHORIZATION: In accordance with the provisions of the 56 Charter of the City of Miami Gardens, Florida and Chapter 166, Florida Statutes, the City 57 Council of the City of Miami Gardens hereby authorizes the borrowing of Six Million Four 58 Hundred Thousand Dollars ($6,400,000). The Bonds shall be designated “City of Miami Gardens, Florida Taxable Land 64 Acquisition Revenue Bonds, Series 2016” or such other designation as may be approved 65 by supplemental resolution, shall be dated such date, shall be in such denominations, shall 66 be stated to mature in such year or years not later than four (4) years from their date of 67 issuance, shall bear interest at a taxable rate from their dated date at a rate or rates not 68 exceeding the maximum rate permitted by law at the time of issuance of the Bonds, shall 69 be subject to redemption at the option of the City at such times and prices, and shall have 70 such other details, all as shall hereafter be determined by the Council by supplemental 71 resolution.. The Bonds shall be secured by a pledge of the utilities service tax and revenue 72 received from State revenue sharing, as further specified by supplemental resolution of the 73 Council. The supplemental resolution may be adopted, and the Bonds may be issued, at 74 any time after the effective date of this Ordinance. 75 76 SECTION 3. AUTHORIZATION OF OFFICERS: The City Manager and the City 77 Finance Director are each hereby authorized to negotiate with banks and other financial 78 institutions for the purchase of the Bonds and with respect to the terms of the Bonds. The Miami Gardens- Bunche Park Neighborhood Watch Program was developed in 2011 as a result of the activities and awareness campaign of the S.A.V.I.O.R. initiative. The 7th annual S.A.V.I.O.R. rally is rescheduled for Saturday, March 26, 2016, with a rally that commences at the corner of 152nd Street and NW 22nd Avenue, culminating at Bunche Park. Item K-4) Consent Agenda Resolution Bid Award/ Waste Management of Florida, Inc. 55 of 115 18605 NW 27th Avenue Miami Gardens, Florida 33056 Current Situation On December 21, 2015, Staff prepared specifications for Invitation To Bid (ITB) Number 15-16-022, Refuse Collection of Leased Containers, which was solicited and posted on Demandstar. A broadcast notice was sent to one hundred eighty-one (181) suppliers. Four (4) bids were received and publicly read on January 12, 2016. The apparent low respondent is Waste Management of Florida, Inc., located in Miami, Florida. The Procurement Department evaluated the bids for compliance with the specifications (Exhibit 1). The initial period of the proposed contract is for two (2) years, from date of award through February 2018, for a total maximum not to exceed amount of one hundred thirty thousand ($130,000) dollars for a two-year period. On July 15, 2015, staff issued Request For Qualifications (RFQ) Number 14-15-034 for Norwood Park and Pool Improvements, Step One, inviting Design-Build firms or teams to provide qualifications for future design-build contract for a new recreational building, renovation of the existing pool house, new playground and shade structure and related facility improvements, technical, schedule and cost proposals to implement an overall improvement project at Norwood Park and Pool, located at 19401 NW 14th Avenue. A broadcast notice was sent to seven hundred seventy-one (771) vendors. Forty-one (41) proposals were requested. The RFQ opened on August 20, 2015 and seven (7) proposals were received and publicly read. The RFQ was prepared in accordance with Florida Statue 287.055 Consultants Competitive Negotiation Act (CCNA). On September 1, 2015, the Selection Committee short-listed four (4) firms: D. Stephenson Construction Inc.; Di Pompeo Construction Corporation; Recreational Design & Construction, Inc.; and West Construction, Inc. CURRENT SITUATION The Procurement Department applied the City of Miami Gardens Business and Resident Economic Growth Plan (CMG-BREP) preference to this project. D. Stephenson Construction, Inc.; Di Pompeo Construction Corporation; Recreational Design & Construction, Inc.; and West Construction, Inc., were compliant to the City of Miami Gardens Business Resident Economic Growth Plan (Exhibit 2). Ferguson Recreational Item L-1) Resolution International Music Festival 77 of 115 18605 NW 27th Avenue Miami Gardens, Florida 33056 Complex’s amphitheater for the City’s first premiere multicultural music concert. Hundreds of adoring fans enjoyed a night under the stars and enjoyed the multi-genre music of Erinsoho John, M.O.G., Filon Jay, Miss African Roots USA Cultural Pageant Queen Rachel Louissant, Ayanbirin, Ivelisse Santos and the award-winning artist Flavour. The event highlighted a market that has gone underserved and who demonstrated through the support of this event, is ready to have access to this type of world class entertainment which is as diverse as South Florida and the City of Miami Gardens. Councilman Erhabor Ighodaro would like to bring this event back to the City of Miami Gardens to fill the gap and promote culture which drives economic activity. This International Music Festival will build upon last year’s highlights to become an annual affair, promoting local, regional and international talent. A grant application will be submitted to the Tourist Development Council Grants FY 2015-2016 for an award of $25,000, projected ticket sales and sponsorships are the anticipated sources of funding. Councilman Ighodaro is requesting sponsorship for the event in the amount of $1,000.00 to be allocated from Account No. 01-12-01-512-492-00, “ City Manager’s Special Events Account” . Fiscal Impact After the above allocation, Councilman Ighodaro will have $1,500 available in the City Manager’s Special Events Account. It is the Committee’s intent to seek sponsorships for this event. • March 2016 – Vote! This is a collaboration between Miami-Dade County Elections, Florida Memorial University Student Government, St. Thomas Student Government Association, Miami Job Corp Student Government Association and the City of Miami Gardens Junior Council Advisory Committee.
