HomeMy WebLinkAbout2020-049-3447 Utility Easement with the City of North Miami Beach RESOLUTION NO. 2020-050-3448 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, RATIFYING THE CITY MANAGER'S AUTHORIZATION TO ISSUE A PURCHASE ORDER TO LTG SPORTS TURF ONE, LLC, FOR THE REPLACEMENT OF EXISTING CHAIN LINK FENCING ENCLOSING THE ARTIFICIAL TURF FIELD AND RUNNING TRACK AT BETTY T. FERGUSON RECREATION CENTER IN AN AMOUNT NOT TO EXCEED SIXTY NINE THOUSAND, ONE HUNDRED TWO DOLLARS ($69,102.00), BY RELYING UPON THAT CERTAIN AGREEMENT BETWEEN THE UNIVERSITY OF CENTRAL FLORIDA AND LTG SPORTS TURF ONE, LLC, FOR THE DESIGN AND INSTALLATION OF INTRAMURAL TURF FIELDS; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, On March 11, 2020, at 10:48 PM, Mayor Oliver Gilbert signed a local state of emergency for the City of Miami Gardens ("City") due to the Coronavirus and subsequently several City Council meetings were cancelled, and WHEREAS, a variety of improvements had been implemented or planned by the City at the Betty T. Ferguson Recreation Center including the replacement of forty eight (48) inch tall perimeter fencing separating the track and field from other stadium improvements due to its deteriorated condition, and WHEREAS, the University of Central Florida, competitively solicited for the design and installation of intramural turf fields under Request for Proposal (RFP), Project Title - Fact Sheet Turf Fields 4-27 on April 15, 2015 resulting in a continuing contract with Sports Turf One Inc. that in turn conveyed all rights and obligations to LTG Sports Turf One, LLC, and WHEREAS, City Staff recommends that the City Council ratify the City Manager's authorization to issue a purchase order to LTG Sports Turf One, LLC by relying up the University of Central Florida Agreement, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby ratifies the City Manager's authorization to issue a purchase order to LTG Sports Turf One, LLC, for the replacement of existing chain link fencing enclosing the artificial turf field and running track at Betty T. Ferguson Recreation Center in an amount not to exceed Sixty Nine Thousand, One Hundred Two Dollars ($69,102.00), by relying upon that certain agreement between the University of Central Florida and LTG Sports Turf One, LLC, for the design and installation of intramural turf. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage. WHEREAS, the redevelopment of Bunche Park, which is currently under construction, is a programmed project funded by the General Obligation Bond is the, and WHEREAS, the project includes a new alternative sports building, artificial turf field, playground, basketball courts, parking lot and hardscape, landscaping and irrigation along with all new underground utilities, and WHEREAS, included in the new utilities are potable water and fire line connections, and WHEREAS, the City of North Miami Beach ("CNMB") requires, as standard practice, the installation of Double Detection Check Valves ("DDCV") or backflow preventers to prevent inadvertent contamination of the public potable water system, and WHEREAS, given site configuration, the DDCV is located just outside the right of way and is on City property, and WHEREAS, the DDCV needs to be contained within an easement to CNMB and this easement provides for CNMB to own, operate, and maintain certain facilities contained within the easement, and WHEREAS, Staff recommends that the City Council approve the easement to the City of North Miami Beach, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution.
