A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, ELECTING TO GIVE ELECTED
OFFICIALS THE OPTION OF JOINING THE ELECTED
OFFICIALS CLASS OF THE FLORIDA RETIREMENT SYSTEM
IN ACCORDANCE WITH SECTION 121.052, FLORIDA
STATUTES; PROVIDING FOR INSTRUCTIONS TO THE CITY
MANAGER; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in 2004 the City of Miami Gardens joined the Florida Retirement
System (FRS) for purposes of pension benefits, and
WHEREAS, in accordance with Section 121.052(2)(0, when the City joined FRS,
City Council members could have elected to be included in the Florida Retirement
System Elected Official's class or the Senior Management class, but the City has been
informed by FRS that at that time the City members were not included in the Elected
Officials class, but were included in the Senior Management class designation, and
WHEREAS, City Council members should have been given the choice to be
included in the Elected Officials class, but were not, and
WHEREAS, the City Council is hereby confirming its rights in accordance with
Section 121 .052 to give it's elected officials the option of joining the Elected Official's
Class of the FRS since the City has been a member of FRS since 2004,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
confirms its intention to give it's elected officials the option of joining the Elected
Officials Class of the FRS from the date of the City joining the Florida Retirement
System.
Section 3: INSTRUCTIONS TO THE CITY MANAGER. The City Manager is
hereby directed to transmit this Resolution to the FRS and to take any and all steps
necessary to effectuate the purpose of this Resolution.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS SPECIAL VIRTUAL MEETING HELD ON JUNE 10, 2020.
