HomeMy WebLinkAbout2020-076-3474 Agreement with MDC Property Appraiser's Office RESOLUTION NO. 2020-076-3474 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST RESPECTIVELY THAT CERTAIN AGREEMENT WITH MIAMI- DADE COUNTY PROPERTY APPRAISER'S OFFICE, FOR ACCESS TO EXEMPT INFORMATION; PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida's public records law (Chapter 119, F.S.) requires the Property Appraiser's Office to maintain as exempt certain personal information of qualifying individuals from its records, and WHEREAS, due to recent changes to Florida's public records law, which went into effect on July 1, 2019, the Property Appraiser's Office must now maintain as exempt certain additional information, including "the physical address, mailing address, neighborhood name and lot number, GPS coordinates, and any other descriptive information that may reveal the home address," and WHEREAS, pursuant to Florida's law, the Property Appraiser's Office may share exempt information with other governmental entities as required for their legitimate governmental operations and it becomes the responsibility of any such entities to protect from disclosure the exempt information as required by the public records law, WHEREAS, the City of Miami Gardens ("City") utilizes the uniform method of collecting non-valorem assessments and to prepare the non-valorem assessment roll, the City requires certain information regarding the properties subject to the assessment, including information exempt from disclosure, and WHEREAS, the City must execute the attached agreement, so that the appraiser's office may provide exempt information to the City for the purpose of preparing the City's non-valorem assessment roll, WHEREAS, City Staff recommends that the City Council authorize the City Manager to excute an Agreement with the Property Appraiser's Office, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby[LW1] authorizes the City Manager and the City Clerk to execute and attest respectively that certain agreement with Miami-Dade County Property Appraiser's Office, for access to exempt information. Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby authorized to obtain two (2) fully executed copies of the subject Agreement with one to be maintained by the City, and one to be delivered to Miami-Dade County Property Appraiser's Office. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
