A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER AND THE CITY CLERK TO EXECUTE AND ATTEST
RESPECTIVELY THE MEMORANDUM OF UNDERSTANDING
(MOU) WITH MIAMI-DADE COUNTY PARKS, RECREATION
AND OPEN SPACES DEPARTMENT ("MDPR") FOR A
SPONSORSHIP CHANGE FOR ROLLING OAKS PARK;
PROVIDING FOR INSTRUCTIONS TO THE CITY CLERK,
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Land and Water Conservation Fund ("LWCF") State Assistance
Program was established by the LWCF Act of 1965 to stimulate a nationwide action
program to assist in preserving, developing, and assuring to all citizens of the United
States of present and future generations such quality and quantity of outdoor recreation
resources as may be available and are necessary and desirable for individual active
participation, and
WHEREAS, LWCF provides matching grants to States and through States to
local units of government, for the acquisition and development of public outdoor
recreation sites and facilities, and
WHEREAS, in 1978, MDPR was awarded Three Hundred Thousand Dollars
($300,000.00) from LWCF for "Rolling Oaks Park" (Project No. 12-00138) to manage
the property according to the administrative procedures and requirements for federal
assistance set forth by the Department of the Interior, and
WHEREAS, the City of Miami Gardens ("the City") was incorporated in 2003 and
as part of its incorporation, MDPR neighborhood and community parks located within
the municipal boundaries, including Rolling Oaks Park, were conveyed to the City in
accordance with Article 6 of the Miami-Dade County Home Charter Rule, and
WHEREAS, MDPR desires to process a LWCF sponsorship change from
"MDPR" to "the City" with the State of Florida's State Liaison Officer (SLO), and
WHEREAS, City Staff recommends that the City Council authorizes the City
Manager to execute the MOU with MDPR,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1 : ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby[LW1] authorizes the City Manager and the City Clerk to execute and attest
respectively the MOU with the MDPR in substantially the form attached hereto as
Exhibit "A".
Section 3: INSTRUCTIONS TO THE CITY CLERK: The City Clerk is hereby
authorized to obtain two (2) fully executed copies of the subject Agreement with one to
be maintained by the City, and one to be delivered to MDPR.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS SPECIAL VIRTUAL MEETING HELD ON JUNE 3, 2020.
