HomeMy WebLinkAbout2020-068-3466 Lease Agreement with New Urban Development RESOLUTION NO. 2020-068-3466 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA, Amending the LEASE AGREEMENT WITH NEW URBAN DEVELOPMENT FOR THE CONSTRUCTION OF SENIOR HOUSING ON CITY-OWNED PROPERTY GENERALLY LOCATED AT THE NORTHWEST CORNER OF NW 12TH AVENUE AND NW 183RD STREET, ATTACHED HERETO AS EXHIBIT "A" IN SUBSTNATIAL FORM; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on March 9, 2016, the City Council approved Resolution No. 2016- 043-2942 directing the City Manager and City Attorney to negotiate a long-term lease/development agreement with the Urban League of Greater Miami for the construction and development of 100 units of senior housing to be located adjacent to the City's proposed Senior Center on the northwest corner of NW 12th Avenue and NW 183rd Street, and WHEREAS, negotiations were undertaken thereafter and a long-term lease agreement was approved by the City Council on September 27, 2017 through Ordinance No. 2017-11-375, and WHEREAS, the developer is requesting an amendment to the existing agreement as shown on Exhibit "A", and WHEREAS, the amendment includes an increase in the number of units from 100 to 150 along with changes to the project amenities, and WHEREAS, under the amendment, the lease term will be changed from fifty (50) years with a twenty-five (25) year option to extend; to fifty-five (55) years with a twenty (20) year option to extend in addition to the ability to sublet or assign the lease, and WHEREAS, the Development Period to complete construction is to be amended to a new project completion date of December 31 , 2024, replacing the previous project completion date of September 4, 2020, and WHEREAS, the Amendment also provides that New Urban would have the right to assign its rights and duties hereunder to a qualified entity under the regulations of the Florida Housing Finance Corporation in order to facilitate tax credit financing in aid of the development of the Property, and WHEREAS, Staff recommends that the City Council approve the amendment to the lease agreement with New Urban Development for the construction of senior housing on City-owned property generally located at the northwest corner of NW 12th Avenue and NW 183rd Street, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens hereby amends the lease agreement with New Urban Development for the construction of Senior Housing on City-Owned property generally located at the northwest corner of NW 12th avenue and NW 183rd street, attached hereto as Exhibit "A" in substantial form. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
