March 11, 2020
1. CALL TO ORDER/ROLL CALL
The City Council for the City of Miami Gardens, Florida, met in regular session,
Mar 11 2020, beginning at 7:08 p.m., in the Council Chambers, 18605 NW 27th
Avenue, Miami Gardens, Florida.
The following members of the City Council were present: Mayor Oliver Gilbert,
Vice Mayor Rodney Harris, Councilman Erhabor Ighodaro, Councilman Reggie
Leon, Councilwoman Lillie Odom, Councilman David Williams Jr., and
Councilwoman Katrina Wilson.
Also in attendance were: City Manager Cameron Benson, City Attorney Sonja
Dickens, and City Clerk Mario Bataille.

5. ORDER OF BUSINESS

DAVID WILLIAMS, JR SPECIAL EVENTS ACCOUNT IN THE AMOUNT OF
FOUR THOUSAND DOLLARS ($4,000.00), NUNC PRO TUNC, TO MARCH 6,

CITY SENIOR HIGH SCHOOL GIRLS FLAG FOOTBALL GAMES; PROVIDING
FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN

Councilman Reggie Leon added a Special Presentation.
Councilwoman Odom pulled Item 11.1 from the Consent Agenda.
City Manager Benson withdrew Item 11.3 from the Agenda.
City Manager Benson recommended Item 13.1.1. be continued to March 25,
2020 City Council Meeting.
A motion offered by Councilman Williams Jr., seconded by Vice Mayor
Harris, to approve the Agenda as amended, passed and carried by a
unanimous voice vote.
6. SPECIAL PRESENTATIONS (5 MINUTES EACH)
6.1. SPECIAL RECOGNITION BY COUNCILMAN REGGIE LEON.
Councilman Reggie Leon recognized City of Miami Gardens residents
Jose Nieves and Justin Glendenning for their heroic action after a fiery
automobile accident that took place on March 4, 2020.
7. PUBLIC COMMENTS
Leroy Conyers, 18714 NW 32nd Place, appeared before the City Council to
address the amount of vehicles that speed through the area of 187th street,
between 32nd and 37th avenue. He suggests speed bumps be placed in the
area to deter speeding.
Mary Reeves, 1521 NW 168th Terrace, Miami Gardens, FL, appeared before
the City Council to commend the two residents for their act of bravery. She
commented on tree preservation/protection and her concern about new
homeowners cutting down and destroying trees in the community. She also
voiced her support of Item 11.1 .
Betty T. Ferguson, 1625 NW 180th Terrace, Miami Gardens, FL, appeared
before the City Council to inquire about an update on the plan to address

Formula 1. She expressed the community's contentment with elected officials
being visible in leading the fight to protect the community. She voiced her support
of Item 11.1. and offered to commend the City if they cancelled Jazz in the
Gardens.
Jacquelyn Webb, 18451 NW 37th Ave., Apt 215, appeared before the City
Council to address unfair treatment with the Property Manager of the Miami
Gardens Apts. She believes residents are not being treated equally. She asked
if the City would send an employee to investigate the issue and to observe the
issues with living conditions.
Denise White, 1210 NW 179th Terr. Miami Gardens, FL, appeared before the
City Council to express concern of obstructed view of traffic signal by sunlight,
in the area of 17th Ave. & 183rd Street when travelling west. She recommended
the City send someone to survey the area.
Andre Green, 17800 NW 22nd Ave., appeared before the City Council as the
Acting Director of Operations for Mt. Hermon AME Church, to announce the
Group Violence Intervention program by Nehemiah Action on Monday, March
16, 2020, at St. James Catholic Church.
Sharon Campbell, 21131 NW 31st Ave, appeared before the City Council to
encourage the community's participation in the group violence event at 7:00 p.m.
on March 16, 2020, at St. James Catholic Church.
Linda Smith, 15815 E Bunche Park Dr., appeared before the City Council to
invite everyone to the Group Violence Intervention program by Nehemiah Action
on Monday, March 16, 2020, at St. James Catholic Church.
Rev. Ana Jackson, 885 NW 213th Lane, Miami Gardens, FL, appeared before
the City Council also to express concern about gun violence in the community
and to encourage the City's leaders to attend the Nehemiah Project.
Upon conclusion of public comments the Mayor open discussion among the
Council regarding the Nehemiah Project and COVID-19.
NEHEMIAH PROJECT
In reference to the Nehemiah Project, Mayor Gilbert asked for clarity on what
they were asking. He explained the City already supported and committed to
who the County suggested to implement the John J curriculum and fully funded
it.
Answering a question posed by the Mayor, City Manager Benson stated the City
agreed to a 3-year commitment at approximately $125,000 per year and that
there were 2 years left on the contract.

Councilman Ighodaro commented on whether there was a duplicity in having the
partnership with Circle of Brotherhood and the John J curriculum. He also stated
committing to one organization doing something doesn't negate the fact that
another organization would be of assistance. He expressed one organization
cannot fix everything.
Mayor Gilbert continued with expressing the need to understand what will be
different from bringing on the Circle of Brotherhood to implement the curriculum
and what isn't happening that the City needs to hire someone different.
Councilman Leon asked for leaders of the Nehemiah Project to set up a meeting
with him to bring up to speed about the organization and what they do.
JAZZ IN THE GARDENS AND COVID-19
Assistant City Manger Vernita Nelson reported on the precautionary measures
that will take place during Jazz in Gardens as it relates to COVID-19. The City
will continue to have communication with local, state, and federal agencies in
order to meet any guidelines they provide.
Councilman Williams Jr. stated given the fact of all of the precautionary
measures taken place there is still no way to stop the spread of the virus.
Mayor Gilbert agreed you can not stop the spread of the virus but we can take
precautions by providing the ability to do the things the Center of Disease and
Control (CDC) recommends to slow the spread. Mayor Gilbert indicated
representatives form the Florida Department of Health (FDOH) are present to
answer questions posed by the Council.
Answering a question posed by Councilwoman Odom, Vanessa Villamil,
Epidemiologist for FDOH, considers outdoor events a bist safer with the way the
air circulates.
Councilwoman Odom raised concerns on how this disease will effect the 50,000
people that will attend Jazz in the Gardens.
Mayor Gilbert stated the demographic of JITG is substantially different compared
to other events that have been canceled such as Ultra and Calle Ocho.
Councilman Williams questioned if the relative risk of factor over 100,000 people
vs. 50,000 people the same.
Ms. Villamil responded it would be hard to speculate the different risk factors
involved in COVID-19.

Councilman Williams Jr. stated to his own point that we do not currently know
the risk factors.
Councilwoman Odom questioned the fiscal impact if the City was to decide if we
was to cancel the event.
Assistant City Manager Nelson responded if the event was canceled the City
could potentially lose the deposits paid to artist, a consideration about refunding
tickets, and the expenses for the site construction that have taken place at this
point.
Answering a question posed by Councilwoman Odom, Mrs. Nelson noted we
have not taken any kind of survey concerning attendance at JITG.
Mayor Gilbert noted tickets are still being purchased to this date.
Answering a question posed by Councilman Leon, Mrs. Nelson indicated no
artist has canceled their obligation with the City.
Councilman Williams Jr. requested to receive information on the deposits paid
to artists.
Answering a question posed by Councilman Williams Jr., Mayor Gilbert indicated
if this body cancels the concern there will be something put into place to issue
refunds to ticket holders.
Councilwoman Wilson recommended we should take due diligence in
understanding our liability should we continue or cancel JITG.
Councilman Leon referenced a webcast by County Mayor Jimenez; where the
County Mayor spoke on JITG along with other open air events to continue.
Mayor Gilbert stated if JITG goes forward the City will go beyond the
recommendations of the CDC. If we had the percentage of international guest of
Ultra, he would suggest cancelling JITG. Mayor Gilbert continued to state
sanitation and the precautions we are taking will be our new normal and
referenced the fact that there has been no Miami-Dade County confirmed cases.
Councilman Williams Jr. noted there are community that have taken the drastic
measures to shut down in order to contain the spread of the virus and would
recommend cancelling JITG.
Mayor Gilbert stated if the facts changes the drastic step would be taken to
declare a local emergency for the City and use the authority of the Mayor to
postpone or cancel the event.

Answering a question posed by Councilwoman Wilson, Mayor Gilbert indicated
there has been not directive form local, state, and federal agencies to no move
forward with JITG.
A motion was made by Councilman Williams Jr., seconded by Councilman
Ighodaro, to cancel Jazz in the Gardens.
Councilman Williams Jr. stated having the event is a risk and should be
postponed until there is more data on the risk related to COVID-19.
There being no further discussion Mayor Gilbert called the question.
A motion to cancel Jazz in the Gardens made by Councilman Williams Jr.,
seconded by Councilman Ighodaro, failed by a 3-4 Roll Call Vote.

"MAINTENANCE REQUIREMENT"OF CHAPTER 34 OF THE CODE OF
ORDINANCES OF THE CITY OF MIAMI GARDENS, TO BE
CONSISTENT WITH FLORIDA STATUTE SECTION 163.045,
PROVIDING FOR ADOPTION OF REPRESENTATIONS; REPEALING

Mayor Gilbert opened the floor for public comments.
There being no comments Mayor Gilbert closed the floor for public
comments.
Mayor Gilbert explained this statute comes from the state, to allow
residents to cut down trees and certify on their own, without having to
come through the City. This law passed by Florida legislature, signed by

the Governor will make it substantially more difficult for the City to cite
residents for removing trees. Mayor Gilbert went on to explain residents
will be required to hire an arborist and the tree is deemed damaged or
distressed, residents will not have to inform the City. He expressed his
discontent with it during first reading and advised this ordinance is law
whether he supports it or not.
Answering a question posed by Councilwoman Odom, City Attorney
Dickens indicated the City would issue a citations through the Code
Enforcement Department and resident are required to show proof as to
why the tree was removed if cited.
A motion offered by Councilman Williams Jr., seconded by
Councilwoman Odom, approve the Ordinance on second reading
failed by a 1 to 6 roll call vote of the City Council.

Councilwoman Odom asked for clarity on the Item and if it was the same
lawsuit discussed in the workshop.
City Attorney Dickens stated it was the same lawsuit and that she did
recommend waiting until the close of pleadings to address the issue.
Mayor Gilbert explained that once a motion was made and the pleadings
were closed, City Council authorized against objecting to become an
indispensable party. He explain the City was the definition of an
indispensable party and has to be a part of the lawsuit.
Councilman Ighodaro expressed the clause was there for the City to join
at the appropriate time.
Mayor Gilbert added the actual lawsuit would not move forward until the
pleadings closed and this puts the City in the best position, with the most
flexibility to do what needed to be done.
A motion made by Mayor Gilbert, seconded by Councilman
Williams, Jr., to approve this Item passed and carried by a
unanimous voice vote.

City Clerk Bataille administered the oath of truthfulness to any
individuals who plan to speak on this Item.
City Manager Benson asked to defer the Item hoping the parties
involved will bring a resolution to some issues that were raised.

Mayor Gilbert explained the Item deals with development in the
Lake Lucerne area and there's no solid solution on another road
out of the area yet.
A motion made by Mayor Gilbert, seconded by Vice Mayor
Harris, to defer this Item until March 25, 2020 was passed
and carried by a unanimous voice vote.

Councilman Leon suggested sanitation stations be placed at the City's Senior
Housing communities, Betty T. Ferguson Community Center and all parks. He
also wished Vice Mayor Harris and Councilwoman Wilson a Happy Birthday.
Councilwoman Wilson announced the Women's Commission - Women's Vote
Symposium on March 30, 2020, from 6:00-8:OOpm. She also expressed how
important it is for our community to show up at the polls and make our presence
known.
Councilwoman Odom thanked the Parks Dept. for setting up the community
center for the Black History Extravaganza and commended Shevrin Jones and
Councilman Leon for serving the attendees of the event. She thanked the Elderly
Affairs Committee for a special recognition presented to her. Councilwoman
Odom also announced a Save the Date for the Annual Mother's Day Luncheon,
Thursday, May 7, 2020, from 10am-2pm.
Councilman Williams, Jr. thanked the community and the City's staff for the
middle school Science Fair.
Mayor Gilbert wished Vice Mayor Harris a Happy Birthday. He offered comments
about the City's Cultural Express trip to see Hamilton and the many opportunities
that the City offers for children and families. He reminded everyone the Laptop
Giveaway would take place on May 20, 2020, at 6pm, at the Community Center.
Mayor Gilbert announced the State of the City on May 13, 2020; the City's 17th
Birthday.
Vice Mayor Harris informed everyone about Census Day and advised everyone
to complete his or her census form.
