A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING THE CITY
MANAGER TO TAKE ANY AND ALL STEPS TO EXECUTE
EASEMENT AGREEMENTS AT BUCCANEER PARK;
PROVIDING FOR THE ADOPTION OF REPRESENTATIONS,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami Gardens ("City") recently completed improvements
to Buccaneer Park located at 20601 NW 32nd Avenue, and
WHEREAS, there is an existing sanitary sewer pump station located within the
Buccaneer Park boundaries that is owned, operated and maintained by Miami Dade
County Water and Sewer Department (WASD), and
WHEREAS, the sanitary sewer pump station is landlocked within the Buccaneer
Park property with the only access being a fifteen (15) foot wide utility easement with an
entrance on NW 30th Avenue, and
WHEREAS, in 2013, Miami Dade County entered into a Consent Decree with the
United States Environmental Protection Agency, the State of Florida and the Florida
Department of Environmental Protection which requires the pump station to be
upgraded for continuity of service to existing properties, increased flows for possible
future development and to minimize future repairs of the pump station and associated
infrastructure, and
WHEREAS, permanent easements are required to complete the installation of
underground utilities including gravity sanitary sewer lines, force mains, and electrical
service in addition to temporary construction easements needed to accomplish the work
by the eventual WASD contractor, and
WHEREAS, City Staff recommends that the City Council authorizes the City
Manager to take any and all steps to execute all necessary easement agreements,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes the City Manager to take any and all steps to execute easement
agreements at Buccaneer Park.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.
