Application RESOLUTION NO. 2020-097-3495 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA APPROVING THE APPLICATION SUBMITTED BY LUBAVITCH EDUCATIONAL CENTER, INC., FOR THE PROPERTY LOCATED AT 1525 NW 167TH STREET, MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO, FOR A VARIANCE OF SECTION 34-288 OF THE LAND DEVELOPMENT REGULATIONS TO WAIVE THE REQUIREMENT THAT A RECREATION/PLAY AREA SHALL BE CALCULATED IN TERMS OF THE PROPOSED MAXIMUM NUMBER OF STUDENTS; PROVIDING FOR THE ADOPTION OF REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Lubavitch Educational Center, Inc. ("Applicant") has applied for a Non-Use Variance from the City of Miami Gardens ("City") to allow 33,341 square feet of recreation/play area where 285,000 square feet are required, and WHEREAS, the subject property is located at 1525 NW 167th Street, within the Planned Corridor Development District ("PCD"), more particularly described in Exhibit "A" attached hereto, and WHEREAS, Section 34-288(20)(g)(1) Physical Standards, of the City's Land Development Regulations, requires that educational facilities provide a recreation/play area calculated in terms of the proposed maximum number of students at the facility, and WHEREAS, the applicant is proposing a maximum enrollment of 880 students with a proposed total of 33,341 square feet of recreation/play area which is insufficient to meet the 285,000 total square feet of recreation area required by the Code, and WHEREAS, the City's Planning and Zoning Staff recommends approval of the application for a non-use variance to allow an 88% reduction in the amount of recreation/play area required, and WHEREAS, the City Council considered the testimony of the Applicant, if any, and WHEREAS, the City Council also considered the testimony of the City's Planning and Zoning Staff, and the Staff Report attached hereto as Exhibit "B" is hereby incorporated by reference, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI GARDENS, FLORIDA AS FOLLOWS: Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas paragraphs are hereby ratified and confirmed as being true, and the same are hereby made a specific part of this Resolution. Section 2: APPROVAL: The City Council of the City of Miami Gardens hereby approves the application submitted by Lubavitch Educational Center, Inc. for a variance of Section 34-288 of the Land Development Regulations waiving the requirement that the recreation area be calculated in terms of the proposed maximum number of students. Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon its final passage.
