A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MIAMI GARDENS, FLORIDA, AUTHORIZING A WAIVER OF
THE FORMAL COMPETITIVE BIDDING PROCESS IN
ACCORDANCE WITH SECTION 2-762 OF THE CITY OF MIAMI
GARDENS CODE OF ORDINANCES; FURTHER
AUTHORIZING A ONE-YEAR EXTENSION OF THAT CERTAIN
AGREEMENT WITH ANTHONY BRUNSON P.A. AND BCA
WATSON RICE, LLP FOR EXTERNAL AUDITING SERVICES
FOR THE BUDGTED AMOUNT; PROVIDING FOR AN
EFFECTIVE DATE; PROVIDING FOR THE ADOPTION OF
REPRESENTATIONS; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with Florida Statutes 218.39, all municipalities are
required to have an annual audit performed by an independent firm of Certified Public
Accountants, and
WHEREAS, on May 27, 2015, the City of Miami Gardens ("City") Staff issued
Request for Proposals ("RFP") 14-15-025 in accordance with Florida Statutes Section
218.391, and
WHEREAS, contracts were awarded via Resolution 2015-131-2328 to Anthony
Brunson P.A. & BCA Watson Rice, LLP for External Auditing Services containing a two
year renewal option, and
WHEREAS, all renewals for the contracts awarded via Resolution 2015-131-
2328 have been exhausted and the contracts have expired, and
WHEREAS, due to the COVID-19 pandemic, the RFP process could not be
completed prior to the commencement of a new audit cycle, and
WHEREAS, Section 2-762 of the City Code of Ordinances, entitled Waiver of
competitive bidding procedures, permits the City Council, upon the affirmative vote of
four City Council members, to authorize the waiver of competitive bidding procedures
upon the recommendation of the City Manager, for services that cannot be acquired
through the normal purchasing process due to insufficient time, and
WHEREAS, City Staff recommends that the City Council authorizes of the waiver
of competitive bidding requirements and extends the contracts of Anthony Brunson P.A.
& BCA Watson Rice, LLP for one year for External Auditing Services,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI GARDENS, FLORIDA AS FOLLOWS:
Section 1: ADOPTION OF REPRESENTATIONS: The foregoing Whereas
paragraphs are hereby ratified and confirmed as being true, and the same are hereby
made a specific part of this Resolution.
Section 2: AUTHORIZATION: The City Council of the City of Miami Gardens
hereby authorizes a waiver of the formal competitive bidding process, in accordance
with Section 2-762 of the City Of Miami Gardens Code Of Ordinances, and further
authorizes a one-year extension of that certain agreement with Anthony Brunson P.A.
and BCA WATSON RICE, LLP for external auditing services for the budgeted amount.
Section 3: EFFECTIVE DATE: This Resolution shall take effect immediately upon
its final passage.

GARDENS AT ITS SPECIAL VIRTUAL MEETING HELD ON OCTOBER 14, 2020.
